Mimi Gamez Photography

By booking services with Mimi Gamez Photography, you (“Client”) agree to the following Terms & Conditions. Please read carefully before reserving your session or event date.

1. Business Information

2. Booking & Reservation

A session or event date is not reserved until:

  • A signed contract is received, and
  • The required non-refundable reservation retainer is paid.

All bookings are accepted on a first-come, first-served basis. Dates cannot be held without payment.

3. Retainer & Payment Terms

  • For weddings, a $500 non-refundable, non-transferable reservation retainer is required to secure services. All other photography services require a $200 non-refundable, non-transferable reservation retainer to secure services.
  • The retainer is applied toward the total balance.
  • Remaining balances are due no later than one (1) week prior to the scheduled session or event date unless otherwise stated in writing.
  • Late payments are subject to a $50 per week late fee.
  • Failure to remit payment may result in cancellation of services and forfeiture of all payments made.
  • Payment plans may be offered at the photographer’s discretion.

4. Cancellations, Rescheduling & No-Shows

  • Client-initiated cancellations forfeit the reservation retainer.
  • For weddings, one reschedule may be permitted with at least 60 days notice. All other photography services require a 48–72 hours’ notice, subject to availability.
  • No-shows result in forfeiture of all payments.
  • Weather-related reschedules for outdoor sessions are determined at the photographer’s discretion.

5. Coverage & Session Time

  • Coverage begins at the scheduled start time.
  • Late arrivals reduce coverage time and do not qualify for refunds.
  • Overtime coverage is billed at the rate outlined in your contract and must be paid prior to delivery.

6. Artistic Style & Creative Control

Client acknowledges familiarity with Mimi Gamez Photography’s portfolio and agrees that:

  • Editing style, color, lighting, and composition are consistent with the artist’s creative vision.
  • Creative decisions are at the sole discretion of the photographer/videographer.
  • Specific shot requests are welcomed but not guaranteed.

7. Deliverables & Turnaround Time

  • Image and video counts are not guaranteed.
  • For weddings, estimated delivery timelines:
    • Photography: 4–8 weeks
    • Videography: 6–12 weeks
  • For all other photography services, estimated delivery timelines:
    • Photography: 2–4 weeks
    • Videography: 3–6 weeks
  • Delivery is via online gallery or digital download.
  • RAW images, unedited files, or unedited footage are not provided.

8. Photography-Specific Terms

  • Photographer is not responsible for uncooperative subjects or missed images due to circumstances beyond control.
  • Minor imperfections (blinking, stray hair, posture) are not considered defects.
  • Retouching beyond standard edits may incur additional fees.

9. Videography-Specific Terms

Client understands that video coverage is subject to:

  • Venue lighting conditions
  • Audio clarity
  • Guest movement and event flow

Mimi Gamez Photography is not responsible for:

  • Audio interference or background noise
  • Incomplete footage due to venue restrictions or timeline delays
  • Missed moments caused by guest obstruction or event changes

Final videos reflect professional editing judgment and storytelling style.

10. Copyright & Usage Rights

  • Mimi Gamez Photography retains full copyright ownership of all images and videos.
  • Clients receive a personal-use license.
  • Commercial or promotional use by the client requires written permission.
  • Images and videos may be used for portfolio, website, social media, and marketing purposes unless the client submits a written opt-out prior to the session.

11. Model Release

Client grants permission for Mimi Gamez Photography to use images and video likeness for lawful promotional purposes unless otherwise stated in writing.

12. Client Responsibilities

Clients are responsible for:

  • Being punctual and prepared
  • Securing permits or permissions at locations
  • Managing personal appearance and wardrobe
  • Ensuring cooperation of all participants

13. Travel Fees

  • Travel within a designated radius is included unless otherwise stated.
  • Additional travel, parking, tolls, or permit fees will be billed to the client.

14. Products, Prints & Albums

  • All print products, albums, canvases, and framed artwork are final sale.
  • Color variations may occur due to print processes.
  • Production timelines vary by product.
  • Reprints due to client-provided errors are chargeable.

15. Image Storage & Archiving

  • Files are archived for a limited time after delivery.
  • Clients are responsible for downloading and backing up their files.
  • Retrieval after archive expiration may incur a fee.

16. Limitation of Liability

  • Liability is limited to the total amount paid.
  • Mimi Gamez Photography is not responsible for circumstances beyond control, including but not limited to weather, illness, acts of God, or venue restrictions.
  • Reasonable care is taken to maintain backup equipment, but total failure liability is limited.

17. Force Majeure

Mimi Gamez Photography shall not be liable for failure to perform due to unforeseen events beyond control. In such cases, a replacement professional or reschedule may be offered when possible.

18. Governing Law

This agreement shall be governed by the laws of the state of Texas.

19. Acceptance of Terms

By booking services with Mimi Gamez Photography, the client confirms understanding and acceptance of all Terms & Conditions listed above.
